Coming into force

The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 19721 in relation to measures relating to maritime transport2, measures relating to the safety of ships and the health and safety of persons on them3 and measures relating to the recognition of higher-education diplomas, formal qualifications, or experience in the occupation, required for the pursuit of professions or occupations4.

The Secretary of State is satisfied, for the purposes of section 47(2) of the Merchant Shipping Act 19955, that it is necessary or expedient, in the interests of safety to make the Regulations in so far as they require ships to carry qualified seamen.

The Secretary of State has consulted such persons as are required to be consulted by sections 86(4) and 306(4) of the Merchant Shipping Act 1995.

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 19726 and by sections 47(1), (4A) and (4B), 85(1), (3), (5) to (7), 86(1) and (2) and 307(1) of the Merchant Shipping Act 19957.
