Amendment of article 4035

Article 40 (appeals to the Appeals Committee) M1 is amended as follows.

After paragraph (1), insert—

A person in respect of whom the Council has failed to make a decision in relation to a European professional card within the applicable time as described by article 39(1A) may appeal to the Appeals Committee by giving notice of appeal to the Registrar within 28 days beginning with the date by which the Council was required to have notified the person of the decision.

In paragraph (7)(b), after “against” insert “
or, in the case of an appeal against a decision falling within article 39(1)(t), direct that the alert be withdrawn or amended
”
.

In paragraph (7)(c), omit the “or” at the end.

After paragraph (7)(c), insert—

with respect to an appeal under paragraph (1A), enter any decision which could have been taken by the Council; or
