Any power of the Secretary of State to make regulations under section 103(4), 106(4) or 205(2) of, or paragraph 2(1) or 3 of schedule 3 to, the 2016 Act is exercisable by statutory instrument.

A statutory instrument containing such regulations is subject to annulment in pursuance of a resolution of either House of Parliament.

Such regulations may make different provision for different cases or classes of case.
