The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 19721.
The Secretary of State has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to tobacco, tobacco products, nicotine, nicotine products and herbal products for smoking2.
