Amendment of regulation 38

27.  In regulation 38 (penalty amount)—

(a) in paragraph (1)—

(i) for “or 7(5), or of the EPC construction duty” substitute “7(5), 7A(2), or 7A(3)”, and

(ii) omit paragraph (4).
