The Recall of MPs Act 2015 (Commencement) Regulations 2016

The Chancellor of the Duchy of Lancaster makes these Regulations in exercise of the powers conferred by section 24(3) of the Recall of MPs Act 2015(1) and now vested in him(2).

Citation

1.  These Regulations may be cited as the Recall of MPs Act 2015 (Commencement) Regulations 2016.

Appointed day

2.  So far as it is not already in force, the Recall of MPs Act 2015 comes into force on 4th March 2016(3).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force the Recall of MPs Act 2015 (c. 25) (“the Act”) in so far as it is not already in force.

The Act was passed on 26th March 2015 and sections 24(1) and (2) commenced various of its provisions on that day.

Regulation 2 brings the remainder of the Act into force on 4th March 2016.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.

Powers under section 24 are vested in “the Minister” which is defined in section 22(1) of the Recall of MPs Act 2015. By virtue of the Chancellor of the Duchy of Lancaster Order 2015 (S.I. 2015/1376), article 3 and Schedule 1, sub-paragraph (t), powers under that Act exercisable by the Secretary of State concurrently by the Lord President of the Council are instead exercisable concurrently with the Chancellor of the Duchy of Lancaster. A consequential amendment to section 22(1) was accordingly made by article 10 of, and paragraph 19 of Schedule 2 to, that Order.

Section 24(1) and (2) of the Act commenced various provisions of the Act on the day on which the Act was passed.
