Providing money for illegal purposesI1133

Where a person knowingly provides money—

a

for any payment which is contrary to the provisions of the Act or these Regulations,

b

for any expenses incurred in excess of the maximum amount allowed by or under the Act, or

c

for replacing any money expended in any such payment or expenses,

that person is guilty of an illegal payment.

A person guilty of an offence under paragraph (1) shall, on summary conviction, be liable to a fine; and on a prosecution for such an offence it shall be sufficient to allege that the person charged was guilty of an illegal payment.

Where an MP (apart from this paragraph) is guilty of an offence under paragraph (1), they are instead guilty of an illegal practice.

Any person charged with an offence of illegal payment may be found guilty of that offence, notwithstanding that the act constituting the offence amounted to a corrupt or illegal practice.
