The Welfare Reform and Work Act 2016 (Commencement No. 1) Regulations 2016

The Secretary of State in exercise of the powers conferred by section 36(5) and (6) of The Welfare Reform and Work Act 20161, makes the following Regulations:

Citation1

These Regulations may be cited as the Welfare Reform and Work Act 2016 (Commencement No. 1) Regulations 2016.

Interpretation2

In these Regulations “the Act” means The Welfare Reform and Work Act 2016.

Commencement

Paragraph 8(1) of Schedule 2 to the Act comes into force on the day after these Regulations are made.

Sections 23, 24, 26 to 32, 33(1), (2), (3), except paragraphs (b) and (c), and (4) to (9) of, and Schedule 2 to, the Act come into force on 1st April 2016 so far as they are not already in force on that date.

Section 3 of the Act comes into force on 16th May 2016.

Section 22 of the Act comes into force on 30th May 2016.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations—

a

bring into force section 3 of the Welfare Reform and Work Act 2016 (“the Act”) on 16th May 2016, which requires the Secretary of State to prepare an annual report on progress made by families who receive support as part of the Troubled Families Programme,

b

bring into force section 22 of the Act on 30th May 2016, which will enable the Secretary of State to make regulations to recover administrative costs of making certain benefit payments to an organisation that leases or sells motor vehicles to disabled persons,

c

bring into force paragraph 8(1) of Schedule 2 to the Act on the day after the Regulations are made which will enable the Secretary of State to issue guidance about determining for the purposes of paragraph 1(5)(a)(iii) or (iv) of that schedule what rate of rent is likely to have been payable by a tenant of particular social housing at a particular time, and

d

bring into force on 1st April 2016 all the social housing rents provisions2 of the Act not already in force on that date, apart from paragraphs (b) and (c) of section 33 which relate to tenancies under Schedule 1 to the Rent Act 1977.
