PART 6U.K.Electronic cigarettes

32.—(1) A producer of electronic cigarettes or refill containers must submit the following information to the Secretary of State—

(a)comprehensive data on the producer's sales volumes in [F1the relevant part of the United] Kingdom, by brand and variant name;

(b)any information available to the producer, whether published or not, on the preferences of consumer groups in [F2the relevant part of the United] Kingdom, including young people, non-smokers and the main types of current users;

(c)the mode of sale of the producer's products in [F3the relevant part of the United] Kingdom; and

(d)executive summaries of any market surveys carried out by the producer in respect of paragraphs (a) to (c).

(2) The information listed in paragraph (1)(a) to (d) must be submitted annually on or before 20thMay each year, and must relate to the preceding calendar year.

(3) The first submission under paragraph (2) is to be made on or before 20th May 2018 in respect of the calendar year 2017.

(4) The information listed in paragraph (1)(a) to (d) relating to the period beginning with 20thMay 2016 and ending with 31st December 2016 must be submitted on or before 20th May 2017.

(5) The Secretary of State must monitor the market developments concerning electronic cigarettes and refill containers, including any evidence that their use is a gateway to nicotine addiction and ultimately traditional tobacco consumption amongst young people and non-smokers.

[F4(6) In this regulation “the relevant part of the United Kingdom”—

(a)in relation to an electronic cigarette which is a GB related product, means Great Britain;

(b)in relation to an electronic cigarette which is an NI related product, means Northern Ireland.]
