PART 3 Transfer of capacity obligations, volume reallocation and over-delivery payments

Regulation 2 (interpretation)

20.  In regulation 2(1)—

(a) in the definition of “capacity obligation”, insert at the end “(and, unless the context otherwise requires, includes a part of a capacity obligation)”;

(b) after the definition of “capacity payment” insert—

““capacity provider” means the holder of—

(a)

a capacity agreement, or

(b)

a transferred part;”;

(c) in the definition of “termination fee”, after “capacity agreement” insert “or transferred part”; and

(d) after the definition of “total system”, insert—

““transferred part” has the meaning given in regulation 30A(3);”.
