Citation and commencement1.

These Regulations may be cited as the Modern Slavery Act 2015 (Duty to Notify) (Amendment) Regulations 2016.

These Regulations come into force on 10th August 2016.

In regulation 3(1), for “paragraphs (2) and (4)”, substitute “paragraph (2), as read with paragraph (2A), and paragraph (4)”.

In regulation 3(2), for “person”, substitute “victim” in each place in which it occurs.

Nothing in paragraph (2) shall be read as requiring the consent of any person in paragraph 4 of Schedule 2 whom the public authority believes may also have been the victim of slavery or human trafficking by the same perpetrator.”.

In paragraph 8(2) of Schedule 1, omit “the public authority must include” and “in the notification”.
These Regulations amend the Modern Slavery Act 2015 (Duty to Notify) Regulations 2015 (S.I. 2015/1743) to correct minor drafting defects.
The Regulations specify that, where the principal victim to whom the notification relates has given their consent or is under the age of 18, no further consent is required from the suspected perpetrators or other suspected victims of those same perpetrators for a public authority to provide the information listed in Schedule 2. The Regulations also remove duplication in one sub-paragraph in Schedule 1.
