The Secretary of State, in exercise of the powers conferred by section 40A(4)(b) of the Harbours Act 1964(1), makes the following Order.

Citation and commencement

1.—(1) This Order may be cited as the Harbour Directions (Designation of Harbour Authorities) (Amendment) Order 2016.

(2) This Order comes into force on 1st October 2016.

Amendment

2.—(1) The Harbour Directions (Designation of Harbour Authorities) Order 2015(2) is amended as follows.

(2) For paragraph 9 of the Schedule substitute–

9.  Mostyn Docks Harbour, being the area described in article 4 (limits of jurisdiction) of the Mostyn Docks Harbour Empowerment Order 1988(3) and extended by the addition of the area described in articles 3(1)(a) and 3(1)(b) (extension of area of jurisdiction) of the Mostyn Docks Harbour Revision Order 2016(4).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Harbour Directions (Designation of Harbour Authorities) Order 2015 so as to reflect the extension to the limits of jurisdiction of Mostyn Docks Limited under the Mostyn Docks Harbour Revision Order 2016 (S.I. 2016/75) so that the area over which the harbour authority may give harbour directions in accordance with sections 40A to 40D of the Harbours Act 1964 is consistent with the extended harbour area.

An impact assessment has not been produced for this instrument as it has no impact on the costs of business, the public sector, charities or voluntary bodies.
