The Secretary of State makes this Order in exercise of the powers conferred by section 105(3) to (6) of the Water Act 2003(1) and after consulting the Welsh Ministers in accordance with section 105(5) and (6) of that Act(2).

The functions of the National Assembly for Wales were transferred to the Welsh Ministers by section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32), therefore the requirement to consult the National Assembly for Wales in section 105(5) and (6) is now a requirement to consult the Welsh Ministers.
