Coming into force in accordance with regulation 1

The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the environmental aspects of product design and makes these Regulations under the powers conferred by that section.

Citation and commencement

1.—(1) These Regulations may be cited as the Ecodesign for Energy-Related Products (Amendment) Regulations 2017.

(2) Subject to paragraphs (3) and (4), these Regulations come into force on 1st January 2018.

(3) Regulation 2(3) comes into force on 1st January 2020.

(4) Regulation 2(4) comes into force on 1st January 2022.

Amendments to the Ecodesign for Energy-Related Products Regulations 2010

2.—(1) The table at paragraph 4 of Schedule 1 (declaration of conformity) to the Ecodesign for Energy-Related Products Regulations 2010(3) is amended as follows.

(2) After item 26(4), insert—

27An air heating product, a cooling product, a high temperature process chiller or a fan coil unitCommission Regulation (EU) No 2016/2281 implementing Directive 2009/125/EC of the European Parliament and of the Council establishing a framework for the setting of ecodesign requirements for energy-related products, with regard to ecodesign requirements for air heating products, cooling products, high temperature process chillers and fan coil units(5)

(3) After item 27 (as inserted by paragraph (2)), insert—

28A solid fuel boilerCommission Regulation (EU) No 2015/1189 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to ecodesign requirements for solid fuel boilers(6)

(4) After item 28 (as inserted by paragraph (3)), insert—

29A solid fuel local space heaterCommission Regulation (EU) No 2015/1185 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to ecodesign requirements for solid fuel local space heaters(7)

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Ecodesign for Energy-Related Products Regulations 2010 (S.I. 2010/2617) (“the 2010 Regulations”) and partially implement Commission Regulations (EU) Nos 2016/2281, 2015/1189 and 2015/1185.

The 2010 Regulations implemented Directive 2009/125/EC establishing a framework for the setting of ecodesign requirements for energy-related products.

The energy-related products are set out in Schedule 1 (declaration of conformity) to the 2010 Regulations, alongside the EU implementing measures which set the ecodesign requirements for those products. Schedule 1 has been amended periodically to include additional products in response to EU implementing measures.

Regulation 2 of these Regulations adds three new entries to the table at paragraph 4 of Schedule 1 to the 2010 Regulations for the following products—

(a)from 1st January 2018, air heating products, cooling products, high temperature process chillers and fan coil units;

(b)from 1st January 2020, solid fuel boilers; and

(c)from 1st January 2022, solid fuel local space heaters.

A full impact assessment has not been produced for this instrument as an assessment of costs and benefits is carried out prior to each of the product-specific EU implementing measures being adopted by the European Commission.
