77.  Nothing in these Regulations prevents the making available on the market of radio equipment which—

(a) is in conformity with the requirements of Directive 1999/5/EC of the European Parliament and the Council on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity M1 , and

(b) is placed on the market on or before the commencement date.
