77. Nothing in these Regulations prevents the making available on the market of radio equipment which—
(a)is in conformity with the requirements of Directive 1999/5/EC of the European Parliament and the Council on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity M1, and
(b)is placed on the market on or before the commencement date.
