The Employment and Support Allowance (Consequential Amendment) (Police Injury Benefit) Regulations 2017

In accordance with section 173(1) of the Social Security Administration Act 1992(2), the Secretary of State has obtained the agreement of the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Employment and Support Allowance (Consequential Amendment) (Police Injury Benefit) Regulations 2017 and come into force on 10th February 2017.

(2) These Regulations extend to England and Wales.

Consequential amendment to the Police (Injury Benefit) Regulations 2006

2.  The Police (Injury Benefit) Regulations 2006(3) are amended as follows.

3.  After paragraph 7(3)(c) of Schedule 3, insert—

(d)any employment and support allowance under sections 1(2)(a) or 1B of the Welfare Reform Act 2007(4)..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police (Injury Benefit) Regulations 2006 to insert a reference to the employment and support allowance paid under sections 1(2)(a) or 1B of the Welfare Reform Act 2007. This means that the amount of injury benefit pension received by a person who is also entitled to employment and support allowance must be reduced by the amount of employment and support allowance to which they are entitled.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
