The amendments made by section 160 of the Act (which are brought into force by regulation 4(i)) do not apply to a pre-commencement application.

In this regulation “pre-commencement application” means an application made before 6th April 2017—

a

under section 37 of the Planning Act 20085 (applications for orders granting development consent), or

b

under Schedule 6 to the Planning Act 20086 (changes to, and revocation of, orders granting development consent).
