Coming into force

The Secretary of State has been designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the environment and matters relating to the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons3.

The Secretary of State has taken into account the selection criteria set out in Annex III to Directive 2011/92/EU of the European Parliament and of the Council of 13th December 2011 on the assessment of the effects of certain public and private projects on the environment4.

In exercise of the powers conferred by section 2(2) of that Act, and also by section 56(1) and (2) of the Finance Act 19735 and with the consent of the Treasury, the Secretary of State makes the following Regulations:
