The Secretary of State makes the following Regulations in exercise of the powers conferred by section 94(1) and (2) of the Immigration Act 2016(1).
1. These Regulations may be cited as the Immigration Act 2016 (Commencement No. 4) Regulations 2017.
2. Section 43 of the Immigration Act 2016 (powers to carry out searches relating to driving licences) comes into force on 31st July 2017 in the police areas of Kent and West Yorkshire (2).

These Regulations bring into force section 43 of the Immigration Act 2016(3), which amends the Immigration Act 1971 to confer on immigration officers, constables and persons authorised by the Secretary of State the power to search for, seize and retain driving licences from persons whom they have reasonable grounds to believe are not lawfully resident in the United Kingdom. These Regulations bring section 43 into force in the police areas of Kent and West Yorkshire only.
