Coming into force

The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 M1 in relation to measures relating to the safety of ships and the health and safety of persons on them M2 and in relation to measures relating to maritime transport M3.

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 43(1), 85(1), (3) and (5) to (7), 86(1) and (2), 121, 122 and 307 of the Merchant Shipping Act 1995 M4 and by section 2(2) of the European Communities Act 1972.

The Secretary of State has consulted such persons as the Secretary of State considers will be affected by the exercise of powers in this instrument in accordance with section 86(4) of the Merchant Shipping Act 1995. The Secretary of State has also consulted organisations in the United Kingdom appearing to the Secretary of State to be representative of persons who will be affected by these Regulations, in accordance with section 306(4)(a) of that Act.
