The Childcare (Miscellaneous Amendments) (EU Exit) (England) Regulations 2018

The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 84(1) and (3), 84A(1) and (3), 90(2) and 104(2) of the Childcare Act 2006(1).

Citation and commencement

1.  These Regulations may be cited as the Childcare (Miscellaneous Amendments) (EU Exit) (England) Regulations 2018 and come into force at 11.00 p.m. on 29th March 2019.

Amendment of the Childcare (Supply and Disclosure of Information) (England) Regulations 2007

2.  In regulation 9(2)(g) in the Childcare (Supply and Disclosure of Information) (England) Regulations 2007(2) substitute “a” for “any other”.

Amendment of the Childcare (Early Years and General Childcare Registers) (Common Provisions) Regulations 2008

3.  In regulation 5(2)(h)(v) in the Childcare (Early Years and General Childcare Registers) (Common Provisions) Regulations 2008(3) substitute “a” for “any other”.

Amendment of the Childcare (Childminder Agencies) (Registration, Inspection and Supply and Disclosure of Information) Regulations 2014

4.  In regulation 19(2)(g) in the Childcare (Childminder Agencies) (Registration, Inspection and Supply and Disclosure of Information) Regulations 2014(4) substitute “a” for “any other”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make minor amendments to the Childcare (Supply and Disclosure of Information) (England) Regulations 2007, the Childcare (Early Years and General Childcare Registers) (Common Provisions) Regulations 2008 and the Childcare (Childminder Agencies) (Registration, Inspection and Supply and Disclosure of Information) Regulations 2014.

The amendments relate to the reference to a national authority of a member state of the European Economic Area, which has functions comprising the regulation of childcare. The amendments reflect the position after the UK leaves the European Union on 29th March 2019, so that national authorities of EEA states will in each case continue to be “prescribed persons”.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
