2.—(1) The Motorways Traffic (England and Wales) Regulations 1982(1) are amended in accordance with paragraph (2).
(2) In regulation 11 (vehicles not to be driven by learner drivers)(2)—
(a)in paragraph (1) for “paragraph (3)”, substitute “paragraphs (3) and (3A)”;
(b)after paragraph (3) insert—
“(3A) Paragraph (1) shall not apply where the holder of the provisional licence—
(a)is driving a category B vehicle the transmission of which may be disengaged, and the brakes operated, independently from the driver by a person sitting in the front passenger seat, and
(b)is under the supervision of a person who is present with him in the vehicle, and whose name is in Part 1 or Part 2 of the register of approved instructors, referred to in section 123(1)(a) and (aa) of the Road Traffic Act 1988(3), and the registration is not suspended.”;
(c)in paragraph (4)(a), for the words “regulations 3(2) and” to the end, substitute “regulations 3(1) and (2)(a) and 4(3) of the Motor Vehicles (Driving Licences) Regulations 1999(4)”.
Regulation 11 was substituted by S.I. 1996/3053.
Section 123(1)(a) was amended by the Driving Instruction (Suspension and Exemption Powers) Act 2009 (c. 17), Schedule 1, paragraph 2 and S.I. 2016/1089. Section 123(1)(a) was also amended by the Driving Instruction (Suspension and Exemption Powers) Act 2009, Schedule 2, but this is yet to be brought into force.
