The Detention Centre (Amendment) Rules 2018

Coming into force
The Secretary of State makes the following Rules in exercise of the powers conferred by section 153 of the Immigration and Asylum Act 19991.
Citation and commencement1
These Rules may be cited as the Detention Centre (Amendment) Rules 2018 and come into force on 2nd July 2018.
Amendment to rule 35 of the Detention Centre Rules2

Rule 35 of the Detention Centre Rules 20012 is amended as follows.

After paragraph (5), insert—

For the purposes of paragraph (3), “torture” means any act by which a perpetrator intentionally inflicts severe pain or suffering on a victim in a situation in which—
a
the perpetrator has control (whether mental or physical) over the victim, and
b
as a result of that control, the victim is powerless to resist.
