1. These Regulations may be cited as the Civil Enforcement of Traffic Contraventions (Consequential Amendments) (England) Regulations 2018 and come into force on 18th May 2018.
2.—(1) Part 1 (parking contraventions) of Schedule 7 to the Traffic Management Act 2004 is amended as follows.
(2) In paragraph 3(2)—
(a)in paragraph (c) for “regulation 18 or 20 of the Zebra, Pelican and Puffin Pedestrian Crossings Regulations and General Directions 1997 (S.I. 1997/2400)” substitute “paragraph 1 or 3 of Part 5 of Schedule 14 to the Traffic Signs Regulations and General Directions 2016 (S.I. 2016/362)”; and
(b)for paragraph (h) substitute—
“(h)an offence under section 36(1) of the Road Traffic Act 1988(3) (failure to comply with traffic sign) of failing to comply with a sign of the type referred to in—
(i)item 51 or 53 in the table in Part 2 of Schedule 14 to the Traffic Signs Regulations and General Directions 2016(4), where that sign is placed for the purposes of a signal-controlled crossing facility or a parallel crossing as defined by Schedule 1 to that Instrument; or
(ii)paragraph 1 of Part 6 of Schedule 7 to that Instrument (bus stop or bus stand clearway markings).”.
(3) In paragraph 4(2)—
(a)after paragraph (b) insert—
“(ba)an offence committed in England under section 25(5) of the Road Traffic Regulation Act 1984(5) of contravening paragraph 1 or 3 of Part 5 of Schedule 14 to the Traffic Signs Regulations and General Directions 2016 (S.I. 2016/362);”;
(b)in paragraph (c) after “offence” insert “committed in Wales”;
(c)after paragraph (h) insert—
“(ha)an offence committed in England under section 36(1) of the Road Traffic Act 1988 (failure to comply with traffic sign) of failing to comply with a sign of the type referred to in—
(i)item 51 or 53 in the table in Part 2 of Schedule 14 to the Traffic Signs Regulations and General Directions 2016, where that sign is placed for the purposes of a signal-controlled crossing facility or a parallel crossing as defined by Schedule 1 to that Instrument; or
(ii)paragraph 1 of Part 6 of Schedule 7 to that Instrument (bus stop or bus stand clearway markings);”; and
(d)in paragraph (i) after “offence” insert “committed in Wales”.
3.—(1) Part 4 (moving traffic contraventions) of Schedule 7 to the Traffic Management Act 2004 is amended as follows.
(2) After paragraph 8 insert—
8A.—(1) The tables in sub-paragraph (5) specify the traffic signs that are subject to civil enforcement in England.
(2) In Table A—
(a)column (1) sets out the description, corresponding to the description in the Traffic Signs Regulations and General Directions 2016 (S.I. 2016/362), of the requirement, restriction or prohibition conveyed by the sign, and
(b)column (2) sets out the number given to the diagram illustrating the sign in that instrument and the place in that instrument where that diagram appears.
(3) In Table B—
(a)column (1) sets out the description, corresponding to the description in the Traffic Signs Regulations and General Directions 2002 (S.I. 2002/3113)(6), of the requirement, restriction or prohibition conveyed by the sign, and
(b)column (2) sets out the number given to the diagram illustrating the sign in that instrument and the place in that instrument where that diagram appears.
(4) References in the tables to any sign include—
(a)any permitted variant of that sign, and
(b)where alternative types are shown, any of those types.
(5) The tables are as follows—

(3) In paragraph 3 for “2002 Regulations” substitute “2016 Regulations”.
(4) For the table in paragraph 4 substitute—

The Traffic Signs Regulations and General Directions 2016 (S.I. 2016/362) revoke and replace with amendments the Traffic Signs Regulations and General Directions 2002 (S.I. 2002/3113), the Zebra, Pelican and Puffin Pedestrian Crossings Regulations and General Directions 1997 (S.I. 1997/2400) and other instruments (“the revoked instruments”).
These Regulations make consequential amendments to provisions in Acts of Parliament which refer to the revoked instruments. Regulation 2 amends, with respect to England, provisions in Part 1 (parking contraventions) of Schedule 7 to the Traffic Management Act 2004 (c. 18). Regulation 3 amends Part 4 (moving vehicle contraventions) of that Schedule to that Act and regulation 4 amends Schedule 3 to the London Local Authorities and Transport for London Act 2003 (c. iii).
A full regulatory impact assessment has not been prepared as this instrument will have no impact on the costs of business or the voluntary sector.

2003 c. iii. Section 4 is brought into force by resolution of a borough council or a decision of Transport for London under sections 1(2) and 3(1) of that Act and notice of such resolution or decision is published in the Gazette (www.thegazette.co.uk) pursuant to section 3(5) of that Act. The list of borough councils which have made such a resolution is available from the Traffic and Technology Division, Department of Transport, Zone 3/27 Great Minster House, 33 Horseferry Road, London SW1P 4DR.
1988 c. 52. Section 36(1) is amended by paragraph 46 of Schedule 6 to the Wales Act 2017 (c. 4).
Items 51 and 53 are amended by S.I. 2017/1086.
Although the Traffic Signs Regulations and General Directions 2002 (“the 2002 instrument”) are revoked by regulation 13 and direction 12 of, and Schedule 19 to, the Traffic Signs Regulations and General Directions 2016 (“the 2016 instrument”), regulation 14(2) and (4) of the 2016 instrument treats certain signs prescribed by, and conforming with, the 2002 instrument as prescribed by, and conforming with, the 2016 instrument.
