The Digital Economy Act 2017 (Commencement No. 5) Regulations 2018

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force subsections (8) and (9) of section 111 of the Digital Economy Act 2017 (c. 30) which amends a number of enactments in light of the repeal of Part 3 of the Data Protection Act 1998. Subsections (1) to (7) of section 111, if commenced, would repeal Part 3 of the Data Protection Act 1998 and make a number of consequential amendments to that Act. Subsections (1) to (7) of section 111 have now been superseded by paragraph 44 of Schedule 19 to the Data Protection Act 2018 (c. 12) which provides for the repeal of the 1998 Act. It is therefore only necessary to commence subsections (8) and (9) of section 111 of the 2017 Act.

These Regulations are the fifth commencement regulations for the Digital Economy Act 2017. The Welsh Ministers have, in addition, made commencement regulations in relation to the disclosure of information to or by a water or sewerage undertaker for an area which is wholly or mainly in Wales, and in relation to the disclosure of information by the Welsh Revenue Authority (S.I. 2018/342 (W. 62) (C.29)).
