44.—(1) Subject to paragraph (2), the functions of the Secretary of State under Part 11 (community infrastructure levy) of the Planning Act 2008(1) (“the 2008 Act”), so far as they are exercisable in relation to Wales, are transferred to the Welsh Ministers.
(2) The function of the Secretary of State under section 218(12) Act (power to amend subsection (11) of that section) of the 2008 is not transferred by paragraph (1).
(3) The Treasury consent requirement in section 205(1) (the levy) of the 2008 Act ceases to apply in so far as the function under that provision is exercised by the Welsh Ministers.
2008 c. 29; Part 11 was amended by sections 114 and 115 of the Localism Act 2011 (c. 20), section 354 of, and paragraph 13 of Part 2 of Schedule 7 to, the Charities Act 2011 (c. 25), article 5 of S.I. 2009/1307, regulation 63 of S.I. 2010/948 and regulation 4(2) of S.I. 2015/664.
