The Secretary of State has been designated M1 for the purposes of section 2(2) of the European Communities Act 1972 M2 in relation to intellectual property (including both registered and unregistered rights).
The Secretary of State makes these Regulations in exercise of the powers conferred by that section and by sections 52, 54 and 78 of the Trade Marks Act 1994 M3.
