The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(1) (“the 1972 Act”).
The Secretary of State is designated for the purposes of the 1972 Act in relation to the common agricultural policy(2).
These Regulations make provision for a purpose mentioned in section 2(2) of the 1972 Act and it appears to the Secretary of State that it is expedient for the references to Articles of the EU instruments listed in the Schedule to these Regulations to be construed as a reference to those Articles as amended from time to time.
1.—(1) These Regulations may be cited as the Sea Fishing (Enforcement) Regulations 2018 and come into force on 20th August 2018.
(2) These Regulations extend to Great Britain.
2.—(1) An inshore fisheries and conservation officer (“IFC officer”) appointed under section 165(1) of the 2009 Act has the powers referred to in section 166(3) of the 2009 Act for the purpose of enforcing the EU fisheries conservation measures.
(2) In paragraph (1), “EU fisheries conservation measures” means the Articles of the EU instruments, as amended from time to time, specified in the Schedule.
(3) Section 166(4) to (9) of the 2009 Act applies to the powers which an IFC officer has for the purpose mentioned in paragraph (1) as it applies to the powers which an IFC officer has for the purposes specified in section 166(1) of the 2009 Act.
(4) In this regulation, “the 2009 Act” means the Marine and Coastal Access Act 2009(3).

These Regulations confer on inshore fisheries and conservation officers the enforcement powers in section 166(3) of the Marine and Coastal Access Act 2009 (c. 23) (“the 2009 Act”) in relation to EU fisheries conservation measures listed in the Schedule, as amended from time to time (see regulation 2(2)). Amending measures affecting the EU fisheries conservation measures may be found on Eur-Lex (https://eur-lex.europa.eu/homepage.html). Regulation 2(3) provides that these enforcement powers may be exercised in accordance with section 166(4) to (9) of the 2009 Act for the purposes of the specified fisheries conservation measures as they may be exercised for the purposes specified in section 166(1) of that Act.
A full regulatory impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
1972 c. 68; section 2(2) was amended by section 27(1)(a) of the Legislative and Regulatory Reform Act 2006 (c. 51) and Part 1 of the Schedule to the European Union (Amendment) Act 2008 (c. 7). Paragraph 1A of Schedule 2 was inserted by section 28 of the Legislative and Regulatory Reform Act 2006 and was amended by Part 1 of the Schedule to the European Union (Amendment) Act 2008 and by S.I. 2007/1388. Under section 57(1) of the Scotland Act 1998 (c. 46), despite the transfer to Scottish Ministers of functions in relation to implementing obligations under EU law in relation to devolved matters, the Secretary of State retains power to exercise such functions as regards Scotland. Under paragraph 5 of Schedule 3 to the Government of Wales Act 2006 (c. 32), despite the transfer to the Welsh ministers of functions in relation to implementing obligations under EU law in relation to devolved matters, the Secretary of State retains power to exercise such functions in relation to Wales.
S.I. 1972/1811, to which there are amendments not relevant to these Regulations. The designation in relation to the common agricultural policy extends to the common fisheries policy under Article 38(1) of the Treaty on the Functioning of the European Union (OJ No. C 326, 26.10.2012, p.62). Functions exercisable by the Minister of Agriculture, Fisheries and Food and the Secretary of State acting jointly were transferred to the Secretary of State by S.I. 2002/794.
