The Town and Country Planning General (Amendment) (England) Regulations 2018

The Secretary of State, in exercise of the powers conferred by sections 316, 333(1) and 336(1) of the Town and Country Planning Act 1990(1), makes the following Regulations:

1990 c. 8; section 316 was substituted by section 20 of the Planning and Compensation Act 1991 (c. 34). Section 336(1) is cited for the definition of “prescribed”. These powers are now vested in the Welsh Ministers so far as they are exercisable in relation to Wales. They were previously transferred to the National Assembly for Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672): see, in Schedule 1, the entry for the Town and Country Planning Act 1990 as substituted by Schedule 3 to the National Assembly for Wales (Transfer of Functions) Order 2000 (S.I. 2000/253). These powers were subsequently transferred to the Welsh Ministers by paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
