The Secretary of State for Transport makes this Instrument in exercise of the powers conferred by Sections 16, 17 and 19 of the Highways Act 19801 and now vested in him2:

This Instrument may be cited as the Highways England Company Limited (M6 Junction 10) (Slip Roads, Special Roads) Scheme 2018 Confirmation Instrument 2019 and shall become operative on the date on which the notice is first published in accordance with paragraph 1 & 4 of Schedule 2 of the Highways Act 1980 stating it has been confirmed.

The Highways England Company Limited (M6 Junction 10) (Slip Roads, Special Roads) Scheme 2018 (“the Scheme”) is hereby confirmed with modifications.

The Scheme as confirmed is set out in the Schedule hereto and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, Room F13, Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA and at the offices of Highways England Company Limited, Lateral, 8 City Walk, Leeds LA11 9AT.

Regulation 3

In this Scheme –

(i)

“Highways England”

means Highways England Company Limited, a strategic highways company registered at Companies House under Company Number 9346363), whose Registered Office is Bridge House, Walnut Tree Close, Guildford, Surrey, GU1 4LZ;

(ii)

“the deposited plan”

means the plan marked “The Highways England Company Limited (M6 Junction 10) (Slip Roads, Special Roads) Scheme 2018”, signed on behalf of, and carrying the common seal of Highways England and deposited at the offices of Highways England Company Limited, Lateral, 8 City Walk, Leeds LS11 9AT; a duplicate copy has been deposited at the offices of the Secretary of State for Transport;

(iii)

“the new highways”

means the new highways to be constructed by Highways England pursuant to, and lettered [B] and [D], in The Highways England Company Limited (M6 Junction 10) (Slip Roads, Special Reports) (Side Roads) Order 2018;

(iv)

“the motorway”

means the special road known as the M6 Motorway;

(v)

“the Schedule”

means the Schedule to this Scheme. and

(vi)

“The special roads”

means the special roads which Highways England are authorised by this Scheme to provide.

Highways England is authorised to provide special roads for the use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980 along the routes described in the Schedule to this Scheme for the purpose of connecting the M6 Motorway with another highway at the place stated in that Schedule.

The centre line of each of the special roads is indicated by a heavy black line on the deposited plan.

Each of the special roads shall become a trunk road on the date when this Scheme comes into force.

THE SCHEDULE TO THE SCHEMETHE ROUTES OF THE SPECIAL ROADS

Regulation 3

Slip roads at the junction with the new highways, at the location of Junction 10 of the motorway in the Metropolitan Borough of Walsall.

A route (given the reference number 1 on the deposited plan) from the northbound carriageway of the motorway to the Junction 10 gyratory where it intersects the A454 Black Country Route.

A route (given the reference number 2 on the deposited plan) from the Junction 10 gyratory where it intersects the A454 Wolverhampton Road to the southbound carriageway of the motorway.

A route (given the reference number 3 on the deposited plan) from the Junction 10 gyratory where it intersects the B4464 Wolverhampton Road West to the northbound carriageway of the motorway.

A route (given the reference number 4 on the deposited plan) from the southbound carriageway of the motorway to the Junction 10 gyratory where it intersects the A454 Wolverhampton Road.

EXPLANATORY NOTE

(This note is not part of the Instrument)

This Instrument confirms a Scheme to construct four new special roads at the location of Junction 10 of the M6 in the Metropolitan Borough of Walsall.

The Secretary of State has modified this Special Road Scheme as follows:

Article 1 “This Scheme may be cited as The M6 Junction 10 (Slip Roads, Special Roads) Scheme 2018 and this Scheme shall become operative on the date on which the Secretary of State publishes a notice in accordance with paragraphs 1 & 4 of Schedule 2 of the Highways Act 1980 stating that it had been confirmed” is deleted. The subsequent paragraphs are renumbered accordingly.

Under “the deposited plan” the words ‘Special Roads, Side Roads’ are deleted and replaced with “Slip Roads, Special Roads”.

Under “the new highways” there are brackets placed before and after the words “M6 Junction 10” to accord with the related Side Roads Order title.

The number (i) before “the special roads” is replaced by (vi).
