5.—(1) Regulation 9 is amended as follows.
(2) Number the existing text as paragraph (1) of that regulation.
(3) After paragraph (1), insert—
“(2) Paragraph (1) does not apply in relation to a person carrying out a regulated activity at an Article 27a installation.”.
