Citation, commencement and interpretation1.
(1)
These Regulations may be cited as the Plant Breeders’ Rights (Amendment etc.) (EU Exit) Regulations 2019 and come into force on exit day.
(2)
In these Regulations—
“the 1997 Act” means the Plant Varieties Act 19972;
“the Controller” has the meaning given in the 1997 Act;
“the Council Regulation” means Council Regulation (EC) No 2100/94 on Community plant variety rights3, as it has effect immediately before exit day;
“existing EU right” has the meaning given in regulation 3;
“variety” has the meaning given in section 1(3) of the 1997 Act.
