This paragraph applies where a designated competent authority has, before IP completion day, sent an alert under regulation 67 of the principal Regulations.

F2Regulation 68 of the principal Regulations continues to apply on and after IP completion day as it had effect immediately before IP completion day, but subject to the modification specified in sub-paragraph (3), in relation to any appeal made in relation to the decision to send an alert.

F3The modification to the principal Regulations is that regulation 68(5)(b) is to be read as if the words “and direct the alert be withdrawn or amended accordingly” were omitted.
