32.—(1) Schedule 5 (persons concerned in collective investment schemes) is amended as follows.

(2) In paragraph 1 M1 —

(a) omit sub-paragraphs (1) and (2), and

(b) in sub-paragraph (4), for paragraph (b) substitute—

“(b) which is a UCITS as defined in section 236A,”.

(3) In paragraph 2, omit sub-paragraph (1).
