98.—(1) Article 39 is amended as follows.
(2) In paragraph 1 for “Member States” substitute “The Secretary of State”.
(3) Omit paragraph 2.
(4) In paragraph 3—
(a)in the first sentence, for “The Commission shall, by means of implementing acts,” substitute “The Secretary of State may, by regulations,”;
(b)in the second sentence, for “shall” substitute “may”;
(c)omit the final sentence.
(5) Omit paragraph 4.
