Regulation 38 is amended as follows.

In paragraph (3), at the end, insert “unless the United Kingdom is entitled under international law to exercise those powers without the consent of the flag state”.

In paragraphs (13) and (14), for “relevant EU instrument”, substitute “relevant retained EU law”.
