The Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulations 2019

Amendment to regulation 68 E+W+S

27.  Regulation 68 (CE Marking) is amended as follows—

(a) in the heading for “CE” substitute “ UK ”;

[F1 (b) for paragraph (1) substitute—

“(1) The UK marking must be affixed visibly, legibly and indelibly—

(a) to the civil explosive; or

(b) where paragraph (1A) applies, to—

(i) a label affixed to the civil explosive; or

(ii) the accompanying documents.”.]

[F2 (ba) after paragraph (1) insert—

“(1A) For a period of 24 months beginning with IP completion day, the UK marking may be affixed to—

(a) a label affixed to the civil explosive; or

(b) the accompanying documents.”]

[F3 (c) in paragraph (2)—

(i) after “Where” insert “ paragraph (1A) does not apply and ”;

(ii) for “CE” substitute “ UK ” (twice);]

(d) in paragraph (3)—

(i) for “CE” substitute “ UK ”;

(ii) for “notified” substitute “ approved ”;

(e) in paragraph (4) for “notified” in each place it appears, substitute “ approved ”;

(f) in paragraph (5) for “CE” substitute “ UK ”.
