16. To the extent that Commission Regulation (EU) No 65/2011 laying down detailed rules for the implementation of Council Regulation (EC) 1698/2005, as regards the implementation of control procedures as well as cross-compliance in respect of rural development support measures M1 continues to operate by virtue of the savings provision in Article 43 of Regulation (EU) No 640/2014, Regulation (EU) No 65/2011 is to be read as if—
(a)Articles 3(1) and (2), 4(1)-(5) and (7), 8-10, 12-15, 17, 19-20, 23-33 and Annex 1 (which have no continuing operative effect) were omitted;
(b)in Article 2—
(i)at point (b), for “national authorities” there were substituted “ relevant authority ”;
(ii)at the end insert—
“(f)“relevant authority” means—
(i)in England, the Secretary of State;
(ii)in Northern Ireland, the Department of Agriculture, Environment and Rural Affairs;
(iii)in Scotland, the Scottish Ministers;
(iv)in Wales, the Welsh Ministers.”;
(c)in Article 7, for “Member States” there were inserted “ relevant authority ”;
(d)In Article 4(9), for “Union or national law” there were substituted “ the law as it applies in the constituent nation ”.
(e)In Article 18(2), for “Member State” there were substituted “ relevant authority ”.

M1Regulation (EU) 65/2011 was repealed by Article 43 of Regulation 640/2014, but under Article 43 of Regulation (EU) No 640/2014, Regulation (EU) No 65/2011 continues to apply payment claims made and application for support relating to the year 2014 and earlier years and payment claims relating to the year 2015 under Article 66(2) of Regulation (EC) No 1698/2005.
