60.  In Article 39—

(a) in paragraph 1, for “The Implementing Regulation opening the tendering procedure or” substitute “ [F1 Any tendering procedure (where tendering applies) or Regulations]”;

(b) omit paragraph 2;

(c) in paragraph 3, omit “the entry into force of the Implementing Regulation”.
