The Electronic Communications (Amendment etc.) (EU Exit) Regulations 2019

Coming into force in accordance with regulation 1

The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of, and paragraph 21(b) of Schedule 7 to, the European Union (Withdrawal) Act 20181.

In accordance with paragraph 1(3) of Schedule 7 to that Act, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.

PART 1Introduction

Citation and commencement1

These Regulations may be cited as the Electronic Communications (Amendment etc.) (EU Exit) Regulations 2019.

They come into force on the later of exit day or the day after the day on which they are made.

PART 2Amendment of primary legislation

Amendment of the Communications Act 20032

In section 4(10)(a) of the Communications Act 20032, after “Directive” insert “(whether before or after exit day)”.

PART 3Amendment of subordinate legislation

Amendment of the Privacy and Electronic Communications (EC Directive) Regulations 20033

Regulation 37 of the Privacy and Electronic Communications (EC Directive) Regulations 20033 is amended as follows.

In paragraph (1)(a), for the words from “implementation” to the end substitute “implementing provisions”.

After paragraph (1) insert—

“The implementing provisions” means the provisions contained in or made under an Act that were relied on by the United Kingdom immediately before exit day to implement the Directive, so far as those provisions remain in force.

Amendment of Regulation (EU) 2015/21205

Regulation (EU) 2015/2120 of the European Parliament and of the Council laying down measures concerning open internet access and retail charges for regulated intra-EU communications and amending Directive 2002/22/EC and Regulation (EU) No 531/2012 is amended as follows.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a) to (c), (e), and (g)) arising from the withdrawal of the UK from the European Union.

These Regulations make amendments to legislation in the field of electronic communications and, in particular, amend legislation relating to the notification of personal data breaches by providers of publicly available electronic communications services, and revoke certain retained direct EU legislation. Part 2 amends primary legislation, Part 3 amends subordinate legislation, Part 4 amends retained direct EU legislation, and Part 5 revokes retained direct EU legislation.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
