31. Article 71 is to be read as if—U.K.
(a)the first sentence were omitted;
(b)for “With regard to the application of the exception, as specified in Article 4(2)(d) of Directive 2003/4/EC”, there were substituted “ With regard to the potential application in relation to emission reports of the exemption in section 43 of the Freedom of Information Act 2000 M1, the exception in regulation 12(5)(e) of the Environmental Information Regulations 2004 M2 or the exception in regulation 10(5)(e) of the Environmental Information (Scotland) Regulations 2004 M3 ”.
