In regulation 52 (gold, precious metals or diamonds)—
a
in paragraph (3)(c), for “non-UK country” substitute “non-Territory country”;

after paragraph (4) insert—
4A
A person who contravenes a prohibition in paragraph (1) commits an offence, but it is a defence for a person charged with the offence of contravening paragraph (1) (“P”) to show that P did not know and had no reasonable cause to suspect that the export was to a DPRK Government person.
4B
A person who contravenes a prohibition in paragraph (2) commits an offence, but it is a defence for a person charged with the offence of contravening paragraph (2) (“P”) to show that P did not know and had no reasonable cause to suspect that the gold, precious metals or diamonds were consigned from a DPRK Government person.
