The Secretary of State is designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the common agricultural policy of the European Union(2) and measures in the veterinary and phytosanitary fields for the protection of public health(3).
The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972, and, with the consent of the Treasury, in exercise of powers conferred by section 56(1) of the Finance Act 1973(4).
1972 c. 68. Section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972 (“ECA”) were repealed by section 1 of the European Union (Withdrawal) Act 2018 (c.16) with effect from exit day, but saved with modifications until IP completion day by section 1A of that Act (as inserted by section 1 of the European Union (Withdrawal Agreement) Act 2020 (c.1)). Section 2(2) of the ECA was amended by section 27(1) of the Legislative and Regulatory Reform Act 2006 (c.51) and by section 3(3) of, and Part 1 of the Schedule to, the European Union (Amendment) Act 2008 (c.7). Despite the transfer to the Scottish Ministers of functions in relation to observing and implementing obligations under EU law, so far as exercisable within devolved competence, the Secretary of State retains power to exercise functions for the purposes specified in section 2(2) of the European Communities Act 1972 as regards Scotland by virtue of section 51(1) of the Scotland Act 1998 (c.46). In relation to Wales, the Secretary of State retains a power to make subordinate legislation for the purposes of implementing any EU obligation of the United Kingdom in relation to Wales, by virtue of paragraph 5 of Schedule 3 to the Government of Wales Act 2006 (c.32).
1973 c.51. Section 56(1) was amended by S.I. 2011/1043, and prospectively amended by paragraph 17 of Schedule 8 to the European Union (Withdrawal) Act 2018 (c.16) from a date and time to be appointed.
