The Occupational and Personal Pension Schemes (Automatic Enrolment) (Amendment) Regulations 2020

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by section 96(2) of the Pensions Act 2008(1).

A draft of these Regulations was laid before Parliament and approved by a resolution of each House of Parliament in accordance with section 143(4) and (5)(a) of the Pensions Act 2008.

Citation and commencement

1.  These Regulations may be cited as the Occupational and Personal Pension Schemes (Automatic Enrolment) (Amendment) Regulations 2020 and come into force on 30th June 2020.

Amendment to the Occupational and Personal Pension Schemes (Automatic Enrolment) Regulations 2010

2.  In the Occupational and Personal Pension Schemes (Automatic Enrolment) Regulations 2010(2) in regulation 1 (citation, commencement, expiry and interpretation)—

(a)in the heading, omit “, expiry”;

(b)omit paragraphs (1A) and (1B).

EXPLANATORY NOTE

(This note is not part of the Regulations)

Regulation 52 of the Occupational and Personal Pension Schemes (Automatic Enrolment) Regulations 2010 applies employer duties relating to personal pensions contained in Part 1 of the Pensions Act 2008, and corresponding provision in Northern Ireland, to persons employed or engaged in any capacity on board a ship.

These Regulations revoke a sunset clause which would mean that regulation 52 would otherwise cease to have effect on 1st July 2020.
