This rule applies where an agreement expires—
a
on its expiry date, or on a date treated as its expiry date; and
b
without having been terminated by the court.

The prosecutor must—
a
as soon as practicable give notice in writing discontinuing the prosecution on the indictment approved by the court under rule 11.4 (Application to approve the terms of an agreement); and
b
serve the notice on—
i
the court officer, and
ii
the defendant.
