The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 45B, 45F(2) and 45P(2) of the Public Health (Control of Disease) Act 1984(1).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, International Travel) (England) (Amendment) (No. 11) Regulations 2020 and come into force at 4.00 a.m. on 29th August 2020.

(2) In these Regulations, “the principal Regulations” means the Health Protection (Coronavirus, International Travel) (England) Regulations 2020(2).

Amendment of the principal Regulations

2.—(1) The principal Regulations are amended as follows.

(2) In regulation 3(4), for “specifying an address in England where that person intends to self-isolate” substitute—

specifying—

(a)in the case of a person who is required to comply with regulation 4, an address in England where that person intends to self-isolate, or

(b)in the case of any other person, an address in England where that person intends to stay during the period of 14 days beginning on the day after the date of their arrival in the United Kingdom.

(3) In regulation 4 (requirement to self-isolate)—

(a)in paragraph (3)(a)(i), omit “as the intended place of self-isolation”;

(b)in paragraph (4), for “The address specified by P in the Passenger Locator Form as the intended place of self-isolation” substitute “Where P is required to comply with this regulation, the address specified by P in the Passenger Locator Form pursuant to paragraph 2(a) of Schedule 1”;

(c)in paragraph (5), after “specified” insert “as the place at which P intends to self-isolate”.

(4) In Part 1 of Schedule A1 (exempt countries and territories)—

(a)omit the entries for “Czech Republic”, “Jamaica” and “Switzerland”;

(b)insert an entry for “Cuba” at the appropriate place.

(5) In Schedule 1 (passenger information)—

(a)for paragraph 2(a) substitute—

(a)the address or addresses in the United Kingdom at which—

(i)in the case of a person who is required to comply with regulation 4, they intend to self-isolate, or

(ii)in the case of any other person, they intend to stay during the period of 14 days beginning on the day after the date of their arrival in the United Kingdom,;

(b)in paragraph 2(b), omit “(where required to comply with regulation 4)”.

(6) In paragraph 4D of Schedule 2, after “the Merchant Shipping Act 1995”(3) insert “, or by a government of a relevant British possession as defined in section 313(1) of that Act”.

(7) For Schedule 3 substitute—

Transitional and saving provision

3.  In relation to any person who arrived in England on or after 10th July but before 4.00 a.m. on 29th August 2020, the principal Regulations apply as if the amendments made by regulation 2(4) had not been made.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, International Travel) (England) Regulations 2020 (S.I. 2020/568) (“the principal Regulations”) to—

(a)require all persons arriving in England from outside the common travel area to provide the address or addresses at which they will stay during the first 14 full days following their arrival in the United Kingdom (regulation 2(2), (3) and (5));

(b)remove the Czech Republic, Jamaica and Switzerland from, and add Cuba to, the list of exempt countries and territories, in Schedule A1 to the principal Regulations, from which passengers arriving in England are not required to self-isolate (regulation 2(4));

(c)amend the exemption for inspectors and surveyors of ships so that inspectors or surveyors appointed by a relevant British possession are exempt from the requirement to self‑isolate in regulation 4 of the principal Regulations and, if they meet the condition in paragraph 4G of Schedule 2 to those Regulations, the requirement to provide information in regulation 3 of the principal Regulations (regulation 2(6));

(d)replace the list of specified competitions in Schedule 3 to the principal Regulations, which is relevant to the exemption from the requirement to self-isolate for elite sportspersons (regulation 2(7)).

Passengers are not required to self-isolate on arrival in England if, during the 14 days preceding their arrival, they have only been in or transited through exempt countries or territories. Passengers who have been in or transited through a non-exempt country or territory must self‑isolate until 14 days have elapsed since the day after they last left a non-exempt country or territory. The changes to Schedule A1 will not affect passengers who arrive in England before 4.00 a.m. on 29th August 2020.
