SCHEDULE U.K. Modifications of standard conditions of licences granted under the Gas Act 1986 and standard conditions of licences granted under the Electricity Act 1989

PART 1 U.K. Interpretation

1.  In this Schedule— U.K.

• “electricity distribution licence” means a licence granted under section 6(1)(c) of the Electricity Act 1989 (distribution licences);

• “electricity interconnector licence” means a licence granted under section 6(1)(e) of the Electricity Act 1989 (interconnector licences);

• “electricity supply licence” means a licence granted under section 6(1)(d) of the Electricity Act 1989 (supply licences);

• “electricity transmission licence” means a licence granted under section 6(1)(b) of the Electricity Act 1989 (transmission licences);

• “gas interconnector licence” means a licence granted under section 7ZA of the Gas Act 1986 (licences for operation of gas interconnectors).

PART 2 U.K. Modifications of standard conditions of licences granted under the Gas Act 1986

2.—(1) The standard conditions of a gas interconnector licence are amended as follows. U.K.

(2) In condition 1 (definitions and interpretation), for the definition of “Agency” substitute—

““Agency” means the European Union Agency for the Cooperation of Energy Regulators established by Regulation (EU) 2019/942 of the European Parliament and of the Council of 5 June 2019 establishing a European Union Agency for the Cooperation of Energy Regulators (recast);”.

PART 3 U.K. Modifications of standard conditions of licences granted under the Electricity Act 1989

Standard conditions of electricity transmission licences U.K.

3.—(1) The standard conditions of an electricity transmission licence are amended as follows.

(2) In condition A1 (definitions and interpretation)—

(a) for the definition of “Agency” substitute—

““Agency” means the European Union Agency for the Cooperation of Energy Regulators established by Regulation (EU) 2019/942 of the European Parliament and of the Council of 5 June 2019 establishing a European Union Agency for the Cooperation of Energy Regulators (recast);”;

(b) for the definition of “the Electricity Regulation” substitute—

““the Electricity Regulation” means Regulation (EU) 2019/943 of the European Parliament and of the Council of 5 June 2019 on the internal market for electricity (recast);”.

(3) In condition B20 (regional cooperation), in paragraph 1, for “Article 12” substitute “ Article 34 ”.

(4) In condition E24 (regional cooperation), in paragraph 1, for “Article 12” substitute “ Article 34 ”.

Standard conditions of electricity distribution licences U.K.

4.—(1) The standard conditions of an electricity distribution licence are amended as follows.

(2) In condition 1 (definitions for the standard conditions)—

(a) for the definition of “Agency for the Cooperation of Energy Regulators” substitute—

““Agency for the Cooperation of Energy Regulators” means the European Union Agency for the Cooperation of Energy Regulators established by Regulation (EU) 2019/942 of the European Parliament and of the Council of 5 June 2019 establishing a European Union Agency for the Cooperation of Energy Regulators (recast);”;

(b) for the definition of “Regulation” substitute—

““Regulation” means Regulation (EU) 2019/943 of the European Parliament and of the Council of 5 June 2019 on the internal market for electricity (recast);”.

5.—(1) The standard conditions of an electricity supply licence are amended as follows.

(2) In condition 1 (definitions for standard conditions), for the definition of “Regulation” substitute—

““Regulation” means Regulation (EU) 2019/943 of the European Parliament and of the Council of 5 June 2019 on the internal market for electricity (recast);”.

Standard conditions of electricity interconnector licences U.K.

6.—(1) The standard conditions of an electricity interconnector licence are amended as follows.

(2) In condition 1 (definition and interpretations)—

(a) for the definition of “Agency” substitute—

““Agency” means the European Union Agency for the Cooperation of Energy Regulators established by Regulation (EU) 2019/942 of the European Parliament and of the Council of 5 June 2019 establishing a European Union Agency for the Cooperation of Energy Regulators (recast);”;

(b) for the definition of “Regulation” substitute—

““Regulation” means Regulation (EU) 2019/943 of the European Parliament and of the Council of 5 June 2019 on the internal market for electricity (recast);”.

(3) In condition 9 (use of revenues)—

(a) in Part B (use of revenues), for “Article 16(6)” substitute “ Article 19(2) and (3) ”;

(b) in Part C (use of revenues statement), in paragraph 5(c), for “Article 16(6)” substitute “ Article 19(2) and (3) ”.

(4) In condition 12 (application of licence conditions 9, 10 and 11: exemption orders)—

(a) in paragraph 2, for “Article 17” substitute “ Article 63 ”;

(b) in paragraph 3, for “Article 17” substitute “ Article 63 ”;

(c) in paragraph 5, for “Article 17” substitute “ Article 63 ”.

(5) In condition 23 (regional cooperation), for “Article 12” substitute “ Article 34 ”.
