These Regulations bring into force paragraphs 44 and 45 of Schedule 3 to the Counter-Terrorism and Border Security Act 2019 (c. 3) (“the 2019 Act”) in relation to Northern Ireland. These provisions relate to the retention of biometric data. These are the second commencement regulations under the 2019 Act, but the first which relate solely to Northern Ireland. The provisions brought into force by these Regulations were brought into force at an earlier date in England and Wales and Scotland by the Counter-Terrorism and Border Security Act 2019 (Commencement No. 1) Regulations 2020 (S.I. 2020/792). The operation of these provisions in Northern Ireland requires the commencement of certain provisions in the Crime and Security Act 2010 (c. 17), which are being brought into force on the same day as these Regulations.
