PART 4General

Review

51.—(1) The Secretary of State must, before the dates specified in paragraph (2)—

(a)evaluate these Regulations, taking into account the speed of technological progress; and

(b)publish a report stating whether or not in their opinion these Regulations should be amended.

(2) The dates referred to in paragraph (1) are—

(a)in respect of regulations 39 to 44 (electronic displays), 25 December 2024;

(b)in respect of regulations 33 to 38 (electric motors), 14 November 2025;

(c)in respect of regulations 9 to 14 (refrigerating appliances with a direct sales function), 25 December 2025;

(d)in respect of regulations 3 to 8 (welding equipment), 14 November 2026;

(e)in respect of regulations 15 to 32 (dishwashers, washing machines, refrigerating appliances), 25 December 2027.

(3) If the Secretary of State concludes under paragraph (1) that any of the regulations referred to in paragraph (2) should not be amended, the Secretary of State must review this conclusion from time to time and publish a new report under paragraph (1)(b) at intervals not exceeding 5 years.

Transitional provision

52.—(1) An energy-related product to which paragraph (2) applies, and which is placed on the market or put into service before the date specified in paragraph (3), is not required to comply with any provision of these Regulations.

(2) This paragraph applies to—

(a)a household dishwasher which, if it had been placed on the market immediately before the coming into force of Chapter 3 of Part 2 of these Regulations, would have complied with EU Regulation 1016/2010(1);

(b)a household washing machine or washer dryer which, if it had been placed on the market immediately before the coming into force of Chapter 4 of Part 2 of these Regulations, would have complied with EU Regulation 1015/2010(2);

(c)a refrigerating appliance which, if it had been placed on the market immediately before the coming into force of Chapter 5 of Part 2 of these Regulations, would have complied with EU Regulation 643/2009(3);

(d)an electric motor which, if it had been placed on the market immediately before the coming into force of Chapter 6 of Part 2 of these Regulations, would have complied with EU Regulation 640/2009(4);

(e)a television which, if it had been placed on the market immediately before the coming into force of Chapter 7 of Part 2 of these Regulations, would have complied with EU Regulation 642/2009(5).

(3) The dates referred to in paragraph (1) are—

(a)for electric motors, 1 August 2021;

(b)for any other product, 1 July 2021.

Amendment of EU Regulation 1275/2008

53.—(1) Commission Regulation (EC) No 1275/2008 of 17 December 2008 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for standby and off mode, and networked standby, electric power consumption of electrical and electronic household and office equipment is amended as follows.

(2) Omit the following entries in paragraph 1 of Annex 1—

(a)“Washing machines”;

(b)“Dish washing machines”;

(3) For paragraph 2 of Annex 1, substitute—

Information technology equipment intended primarily for use in the domestic environment, but excluding desktop computers, integrated desktop computers and notebook computers as defined in Commission Regulation (EU) No 617/2013(6), as well as electronic displays covered by the Ecodesign for Energy-Related Products and Energy Information Regulations 2021(7)..

(4) In paragraph 3 of Annex 1, for the last entry substitute—

And other equipment for the purpose of recording or reproducing sound or images, including signals or other technologies for the distribution of sound and image other than by telecommunications, but excluding electronic displays covered by the Ecodesign for Energy-Related Products and Energy Information Regulations 2021..

Amendment of the 2010 Regulations

54.—(1) The table at paragraph 4 of Schedule 1 (declaration of conformity) to the 2010 Regulations is amended as follows.

(2) For the entry relating to a television at item 6, substitute—

(3) Substitute “The Ecodesign for Energy-Related Products and Energy Information Regulations 2021” for the entry in the final column of—

(a)item 8 (motor);

(b)item 9 (household refrigerating appliance);

(c)item 11 (household dishwasher).

(4) For the entry relating to a household washing machine at item 12, substitute—

12A household washing machine or a household washer-dryerThe Ecodesign for Energy-Related Products and Energy Information Regulations 2021.

(5) At the end of the table, add the following entries—

31Welding equipmentThe Ecodesign for Energy-Related Products and Energy Information Regulations 2021
32A refrigerating appliance with a direct sales functionThe Ecodesign for Energy-Related Products and Energy Information Regulations 2021.

Amendment of the Energy Information Regulations 2011

55.  In the Energy Information Regulations 2011(8), at the end of the table in paragraph 1 of Schedule 1 (product-specific measures), add the following entry—

Refrigerating appliances with a direct sales functionThe Ecodesign for Energy-Related Products and Energy Information Regulations 2021The date specified for the coming into force of Part 3 of the Ecodesign for Energy-Related Products and Energy Information Regulations 2021.

Revocations

56.  The Regulations specified in Schedule 29 are revoked.
